The variety are relies upon components, for example, assets, needs, purchasing demeanor, areas and purchasing practice. Division implies separating a market by specific measures, for example, geological, segment, psychographic and social. By isolating the market, an advertiser can without much of a stretch distinguish what kind of fragment is reasonable for the picked item and enormous market can be partitioned into littler portions which can be overseen all the more productively and successfully. These measures or factors that be utilized for division are as per the following: (1) Geographic Segmentation It alludes to area including areas, landmass, nation, region size, town, city and the atmosphere. An organization needs to put consideration on fluctuation of geographic needs and needs. A section having demographically assembled clients may have distinctive psychographic attributes. (4) Behavioral Segmentation Other than the abovementioned, another reason for division is conduct division. This is the most positive division as it utilizes the factors that truly near the item itself. Purchasing status, purchasing job and client type are the basic social division. Some customersâ are brand faithful; they will in general stick with their favored image. Compelling division is accomplished when clients sharing the comparable examples of interest are assembled, where each gathering distinctive in the example of interest from different fragments in the market. Essentially, all the accompanying must be considered before division: (1) Measureable: Able to gauge as far as potential clients in each fragment which implies it ought to have the option to tell what number of potential clients just as what number of rivals in a similar portion. Focusing on After division, the subsequent stage is focusing on. Focusing on is the way toward choosing a section to point. As indicated by Kotler and Armstrong (2004), the accompanying three primary techniques that can be utilized to enter and misuse the sections. (1) Undifferentiated systems (mass showcasing) â⬠The point of the system is to offer an essential item that would suit and be utilized by practically all age gatherings and way of life. (2) Differentiated techniques (divided advertising) â⬠Focus on focusing on at least two markets, every one of them utilize distinctive showcasing program. (3) Concentrated procedures (specialty advertising) â⬠The organization centers around focusing on a huge portion of one or a couple of sections. The specialty promoting characterizes the particular item includes center to fulfill explicit market needs. By and large, focusing on is relying upon a few factors as the followings: â⬠¢ The current degree of rivalry and the capacity to address client issues. â⬠¢ The size of the portion (how huge and how might it develop). â⬠¢ The qualities of an organization that can assist with engaging a gathering client (organization notoriety). â⬠¢ The capacity to speak with the portion. Essentially, the benefits of target showcasing are: â⬠¢ Marketing openings and ââ¬Ëgapsâ⬠will be all the more precisely indentified. The holes can be the genuine article about the item or how clients see the item inwardly. By indentifying this, a fitting publicizing message can be actualized in the brains of clients. â⬠¢ Market and item claims through the control of promoting blend will be progressively appropriate to the necessities of potential clients. â⬠¢ Marketing exertion can be center around the market section which would be a potential for the organization to accomplish itââ¬â¢s objective and augment the benefit. Situating In the wake of dividing a market and afterward focusing on a client, the following procedure is to situate an item in the market. Situating is about ââ¬Ëperceptionââ¬â¢ and making the picture of the item in customerââ¬â¢s mind. As it were, situating is tied in with conveying the one of a kind selling bit of leeway of the item. Situating is helpful so as to comprehend what we can offer that different items can't offer. What's more, the customerââ¬â¢s needs and needs can be fulfilled. . An item must have an unmistakable and particular picture in the psyche of the client. This is actually what situating makes. Essentially, the situating procedure is for the most part concentrating on the accompanying focuses: â⬠¢ Provide an incentive to client with the upper hand, qualities and particular skills. â⬠¢ Market division frames the reason for centered methodologies. â⬠¢ Finding the exceptional selling suggestion by recognizes a brand from its rivals. â⬠¢ Conduct investigation to concentrate on inner, advertise and contender. Situating is the way toward making, the picture the item holds in the brain of clients about the item. For instance, Gardenia and Federalà Bakery both are in the bread kitchen industry. Albeit Federal Bakery may attempt to contend they will in any case be viewed as down market from Gardenia. Situating enables clients to comprehend what is special about the items when contrasted and the contenders. Gardenia has been situated dependent on the way toward situating by direct examination with different contenders, for example, Italian Baker (Massimo) and Silverbird (Hi-5), and have situated their items to profit their objective market. The vast majority make a picture of an item by contrasting it with another comparative item and the picture of that has been situated by the clients about Gardenia is especially on the assortment that they offers and its solid fixings. The organization can utilize Point of Different (POD) and Point of Parity (PAP) in the push to improve a situating procedure. By utilizing POD and PAP, the organization would have the option to see the distinction and likenesses between their items and competitorââ¬â¢s brand. Itââ¬â¢s critical to build up the POD however itââ¬â¢s additionally imperative to diminish the opposition by coordinating it on the POP. [pic] Chart 2: Point of Different and Point of Parity Utilizing Point of Different (POD) and Point of Parity (PAP) for Gardenia and itââ¬â¢s rivals in the bread shop industry, the outcome are as demonstrated as follows: Purpose of Different (POD) â⬠¢ Large assortment of breads, for example, sunflower seed portion, nectar portion. â⬠¢ No additives and utilize normal fixings. Purpose of Parity (PAP) â⬠¢ Produce the essential thing like the contenders (portion, bun). A few clients like to purchase Gardenia than itââ¬â¢s contender, for example, Federal Bakery, Massimo and Hi-5 in view of the distinctions that different contenders canââ¬â¢t offer. The assortment of bread (other than ordinary white portion) that they are contributions isn't accessible with competitorââ¬â¢s brand and they additionally sellâ other things like waffles and biscuits. The Importance of Positioning It is significant for an effective business to advertise itself right. Through situating, a great deal of promoting cash can be spared. Situating is about correspondence of the general incentive that has been made and keeps up it to the clients. So as to be successful, the fundamental offer by the organization must be something applicable to the objective market and it must be separated from the contenders. It should likewise maintainable and conveyed obviously to that showcase. Along these lines, separation at item, brand or organization level is presently been perceived as one of the key component of building up a steady market situating. The separating can be based

The Means of Acceptance in Contract Law - Free Essay Example
THE MEANS OF ACCEPTANCE Acceptance is the second stage of discovering whether an agreement has been reached under classical contract theory is to look for an acceptance which matches the offer that has been made. No particular formula is required for a valid acceptance. As has been explained above, an offer must be in a form whereby a simple assent to it is sufÃâà ¬Ãâà cient to lead to a contract being formed. It is in many cases, therefore, enough for an acceptance to take the form of the person to whom the offer has been made simply saying à ¢Ã¢â ¬ÃÅ"yes, I agreeà ¢Ã¢â ¬Ã¢â ¢. In some situations, however, particularly where there is a course of negotiations between the parties, it may become more difÃâà ¬Ãâà cult to determine precisely the point when the parties have exchanged a matching offer and acceptance. Unless they do match exactly, so the classical theory requires, there can be no contract. An à ¢Ã¢â ¬ÃÅ"offerà ¢Ã¢â ¬Ã¢â ¢ and an à ¢Ã¢â ¬ÃÅ"acceptanceà ¢Ã¢â ¬Ã¢â ¢ must fitÃâà t together like two pieces of a jigsaw puzzle. If they are not the same, they will not slot together, and the picture will be incomplete. At times, as we shall see, the English courts have adopted a somewhat Ãâà ¬Ã ¢Ã¢â ¬Ã
¡exible approach to the need for a precise equivalence. Nevertheless, once it is decided that there is a match, it is as if the two pi eces of the jigsaw had been previously treated with à ¢Ã¢â ¬ÃÅ"superglueà ¢Ã¢â ¬Ã¢â ¢, for once in position it will be very hard, if not impossible, to pull them apart. The acceptance can be in many circumstance in order to communicate the acceptance of offer. First is acceptance by conduct which usually in unilateral contract, the acceptance will always be by conduct. This issue was considered in Brogden v Metropolitan Railway where the plaintiffs sent the defendants a draft agreement for the supply of a certain quantity of coal per week from 1 January 1872, at Ãâà £1 per ton. The defendants completed the draft by adding the name of an arbitrator, signed it and returned it to the plaintiffs. This constituted an offer. The plaintiffsà ¢Ã¢â ¬Ã¢â ¢ manager, however, simply put the signed agreement into a drawer. There was no communication of acceptance by the plaintiffs. Coal was ordered and delivered on the terms speciÃâà ¬Ãâà ed in the contract for a period of time, until there was a dispute between the parties. The defendants then argued that there was no contract, because the plaintiffs had never accepted their offer, as contained in the signed agreement. The House of Lords conÃâà ¬Ãâà rmed that it was not enough that the plaintiffs should have decided to accept there had to be some external manifestation of acceptance. In this case, however, that was supplied by the fact that the plaintiffs had placed orders on the basis of the agreement. The defendants should therefore be taken to be bound by its terms.[1] Next is acceptance by silence which can be proven in the case Felthouse v Bindley (1862) where the uncle was negotiating to buy a horse from his nephew. The uncle wrote to his nephew offering a particular sum and saying à ¢Ã¢â ¬ÃÅ"If I hear no more about him, I consider the horse mineà ¢Ã¢â ¬Ã¢â ¢. The nephew did not respond, but told an auctioneer to remove this horse from a forthcoming auction. The auctioneer omitted to do so, and the horse was sold to a third party. The uncle sued the auctioneer, and the question arose as to whether the uncle had made a binding contract for the purchase of the horse. There was no contract, because the nephew had never communicated. The case was held that his intention to accept his uncleà ¢Ã¢â ¬Ã¢â ¢s offer. It is true that he had taken an action (removing the horse from the auction) which objectively could be taken to have indicated his intention to accept, but because his uncle knew nothing of this at the time, it was not effective to complete the contract[2]. Lastly is the acceptance by post which I will explain in detail the reason by the court for the postal acceptance rule and in what circumstances will be postal acceptance not operate. I will also include the relevant case study in this section. INTRODUCTION OF POSTAL RULE A requirement of communication will not, however, answer all problems. In the modern world communica tion can take many forms such as face-to-face conversations, telephone, letters, faxes, or email. In some of these, there will be a delay between the sending of an acceptance and its coming to the attention of the offeror. The law of contract has to have rules, therefore, to make clear what is meant by à ¢Ã¢â ¬ÃÅ"communicationà ¢Ã¢â ¬Ã¢â ¢. The simplest rule would be to say that no communication is effective until it is received and understood by the person to whom it is addressed. This is, in effect, the rule that applies to offers, though, as we shall see, there are some cases which suggest that it may be possible to accept an offer of which you are unaware. These cases are of dubious authority, however, and can only possibly apply in very restricted circumstances. In any case, they simply suggest that in some situations, communication of an offer may not be necessary. Where communication of the offer is required, which is the case in virtually all situations, it is sa fe to say that communication means that the person to whom the offer is addressed is aware of it. Why should the position be any different as regards acceptances? The problem Ãâà ¬Ãâà rst arose in relation to the post, where the delay is likely to be longest. Generally speaking, there will be a delay of at least 12 to 18 hours between the sending of an acceptance by post, and its receipt by the addressee. According to the Enfores v Miles Far East Corporation (1955) case, it state that long-understood need for acceptance to be communicated, what constitutes effective communication can be debatable. Here is the fact of the Enfores v Miles Far East Corporation case. Enfores sent a telex massage from England offering to purchase 100 tons of Cathodes from the Miles Far East Corporation in London. The offer was accept by the Dutch agent. Communication took place when a clerk type a massage that was at the same time and automatically printed by the recipientà ¢Ã¢â ¬Ã¢â ¢s machine. Enfores argued that the contract was complete when the offeror received the telex massage of acceptance in England. But Miles Far East said that the contract was finish when acceptance massage was sent in the Holland. The court held that the contract was made in England because to amount to an effective acceptance the acceptance needed to be communicated to the offeree. WHAT IS DECISION IN ADAM V LINDSELL (1818) In the case Adam Lindsell (1818) the defendants sent a letter to the plaintiffs offering wool for sale, and he asking for a reply à ¢Ã¢â ¬ÃÅ"in course of postà ¢Ã¢â ¬Ã¢â ¢. The letter was misdirected by the defendants, and arrived later than would normally have been the case. The plaintiffs replied at once accepting, but the defendants, having decided that because of the delay the plaintiffs were not going to accept, had already sold the wool elsewhere. The plaintiffs sued for breach of contract. The court decided that to require a posted acceptance t o arrive at its. The court held that destination before it could be effective would be impractical and in efÃâà ¬Ãâà cient. The acceptor would not be able to take any action on the contract until it had been conÃâà ¬Ãâà rmed that the acceptance had arrived. The court felt that this might result in each side waiting for conÃâà ¬Ãâà rmation of receipt of the last communicational inÃâà ¬Ãâà nitum. This would not promote business efÃâà ¬Ãâà cacy. It would be much better if, as soon as the letter was posted, the acceptor could proceed on the basis that a contract had been made, and take action accordingly. The plaintiffs therefore succeeded, the defendants were in breach of contract. The court, in coming to this conclusion, was thus giving priority to the practicalities of doing business over the question of whether, at the time the contract was formed, the parties were in agreement. It was quite possible that by the time the letter of acce ptance was posted, the offeror had had a change of mind and sent a withdrawal of the offer, or made a contract with someone else. Nevertheless, because in the courtà ¢Ã¢â ¬Ã¢â ¢s view the conduct of business would in general be better served by giving the offeree certainty in this situation, the postal rule was established[3] The reason that have been given by court for the Postal rule is, an exception to the general rule citing that an acceptance is only create when communicated directly to the offeror. The posting regulation stated, by contrast, that acceptance takes effect when a letter is posted. It also state that if an offer are made by post, then the acceptance are made during the time of post. While the decision in the Henthorn v Fraser (1892) is it was held to be reasonable to post acceptance in response to an oral offer because the parties lived some distance away from each other[4]. This is the brief about the case that I understand which is on 7th July Henthor n from Birkenhead, called office of land society in Liverpool. Henthorn negotiated to buy some houses belonging to the land society. Secretary agreed to sell to him, giving him an option of purchase for 14 days at Ãâà £750. After that, on 8th July Morning, Another person called, offered Ãâà £760 for the property, offer accepted. At 12-1 pm, Secretary withdrawed the offer made to Henthorn. 3.50pm, Claimant delivered letter accepting the offer, but letter arrived at 8.30 pm, after the office was closed. At 5pm, Withdrawal offer arrived at Birkenhead. Secretary opened the letter on the next morning. Claimant sued for specific performance. The court held the case for specific performance granted, Postal Rule applies as acceptance occurred before. Defendant was told to sell the land. In conclusion, the offeree in Henthorn, on the other hand, certainly knew of the offerorà ¢Ã¢â ¬Ã¢â ¢s promise to give him an option à ¢Ã¢â ¬Ã
âfor fourteen daysà ¢Ã¢â ¬Ã and qu ite possibly relied on it. Arguably, therefore, the à ¢Ã¢â ¬Ã
âmailboxà ¢Ã¢â ¬Ã rule should work in favor of offerees but not against them. But this might allow offerees to speculate at the offerorà ¢Ã¢â ¬Ã¢â ¢s expense, using the telephone or telegraph to overtake a letter of acceptance in transit when the market shifts[5] EXCEPTION TO THE POSTAL RULE Here is some cases that exception to the postal rule. First is Quenerduaine v Cole (1883) which is the defendant made an offer by telegram where the plaintiff be told to accept by letter. The court said that an offer which are made by telegram, shows that the quick acceptance are required so that the postal rule was not applied. Second in the Household Fire and Carriage Accident Insurance Company v Grant which Grant offer to buy the shares from Household Fire and Carriage Accident Insurance Company. Then the company accept Grant offer and allotted the shares to him. Later, the latter of allotment was sent to h im to the address that he give. The latter never reached to him until a month later then he received the letter that ask him for a payment of a partly paid and demand by the company for Grant to pay the next instalment due on shares. So that the court conclude that Grant does not receive his allotment later. This is means in practice a contract complete upon the acceptance of an offer being posted, but liable to be put an end to by an accident in the post, would be more mischievous than a contract only binding upon the parties to it upon the acceptance actually reaching the offerer. Third in Yates Building Co. Ltd v. Pulleyn Son (York) Ltd (1975) case which they make a states that any requirements about the method of acceptance must be clearly stated to be valid. In this case, Pulleyn give Yates to buy a building land. The option hereby granted shall be exercisable by notice in writing given by or on behalf of Yates to Pulleyns or to Pulleyns solicitors at any time between April 6 1973 and May 6 1973 such notice to be sent by registered or recorded delivery post to the registered office of Pulleyns or the offices of their said solicitors. On Monday April 30 1973 Yatess solicitors posted a letter to Pulleyns solicitors to formally exercise the option; they enclosed a cheque for Ãâà £1,890 for the deposit. The letter was sent by ordinary post and not by registered or recorded delivery post but it arrived well in time. It was opened by Pulleyns solicitors at some time on or before Friday May 4 1973. On that Friday Pulleyns solicitors wrote back to Yatess solicitors returning the cheque for the deposit and said: à ¢Ã¢â ¬ÃÅ"we write to acknowledge receipt today of your letter of April 30 1973 with its enclosure. You will recall that clause 2 of the option agreement provides for notice to be sent by a registered or recorded delivery post. Your letter was not so sent. Yates brought proceedings for specific performance, but the judge refused it. He held that this requirement that the letter had to be sent by registered or recorded delivery post was a requirement which must be complied with, and as it had not been complied with, there was no contract. Yates appealed.[6] Fourth is Tinn v Hoffman (1873) case which means that where a requirement for a certain type of reply has been made, an equally effective mode of communication will also be deemed acceptable provided it is just as quick and does not disadvantage the offeror. An offer by e-mail could therefore be accepted by telephone[7]. In this case the judge held that an acceptance could be effective even though it departed from the wording of the offer by making express some term which the law would in any case imply. And reply add some new provision by way of indulgence to the offer may be acceptance. Conversely, an acceptance in which acceptor ask for extra time to pay may be effective, so longs as he makes it clear that he is prepared to perform in accordance with the term of the offer event if his request is refused. WHAT DOES PROPERLY POSTED MEANS In the case in Re London and Northern Bank (1900), the letter of acceptance was not properly posted because the letter of acceptance was handed to a postman only authorised to deliver mail and not to collect it. In this case, even though the letter was actually posted, the courts held that handing the letter to a postman was not accepted way of à ¢Ã¢â ¬ÃÅ"postingà ¢Ã¢â ¬Ã¢â ¢. They referred to the actual à ¢Ã¢â ¬Ã
âPostal Guideà ¢Ã¢â ¬Ã which clearly described instructions where postmen were allowed to take letters only from a post box. It is apparent that the courts wanted to prevent the situation where the postal rule would apply to any means of à ¢Ã¢â ¬ÃÅ"postingà ¢Ã¢â ¬Ã¢â ¢ or à ¢Ã¢â ¬ÃÅ"sendingà ¢Ã¢â ¬Ã¢â ¢ letter and therefore restricted it only to Post Office and its guidelines. It is imperative to remember that the postal rule will also not be applicable where it would cause manifest inconvenience and absurdity. DOES THE POSTAL RULE APPLY TO REVOCATION It is clear from the abovementioned, that the application of the postal rule can have different variations and implications. When considering its function, it is essential to know when an acceptance becomes legally effective and also whether it can be revoked. The à ¢Ã¢â ¬ÃÅ"arguableà ¢Ã¢â ¬Ã¢â ¢ point when considering relevance of postal rule in 21st century is that in view of courts, before the acceptance is made the offeror can call the offer off, but once the acceptance has even made this is no longer possible.[8] Fundamentally, the offer may be revoked by the offeror only until that time it is being accepted and furthermore the revocation must be communicated to the offeree otherwise desired revocation will be ineffective. In this case, there are two case that relate with this situation. First is Byrne Co v. Van Tienhoven Co (1880) where Van Tienhoven mailed proposal to sell 1,000 boxes of tin plates to Byrne at fixed price on October 1st. later, Van Tienhoven mailed a revocation of offer on October 8th. But Byrne does not receive the revocation until 20th. In the middle on October 11th Byrne receive the original offers and accepted by telegram and turned around and resold the merchandise to a third party on the 15th. He brought an action for non-performance. However, the courts confirmed the long-standing idea that any revocation of an offer must be communicated to the offeree, although again there are some exceptions to this rule. Next case is Dickinson v. Dodds (1876) case which the revocation can be informed by a reliable third party. This can proved by the situation where the Dodds accepted an offer from a third party to purchase the house. Dodds then asked a friend to tell Dickinson that the offer was withdrawn. On hearing the news, the Dickinson went round to the house first thing Friday morning purporting to accept the offer. He then brought an action seeking specific performance of the contract. In this case the court held that the offer had been effectively revoked. Therefore no contract existed between the parties. There was no obligation to keep the offer open until Friday since the claimant had provided no consideration in exchange for the promise. The offeror is free to withdraw the offer at any time before acceptance takes place unless a deposit has been paid[9] CONCLUSION In order to apply the postal rule, both parties need to really understand the condition of their contract. They must aware to the risk that they will faced during the period of affair agreement such as delaying of the letter, the missing of the letter and also misdirect the letter. Not only that, while the posting of the acceptance, they must know at the time they post, the acceptance are made. Moreover, it is evident that the arguments relating to retention or desertion of the general rule are advanced, it is also clear from the aforementioned that in order to provide the valid conclusion the legislators have to consider many aspects of communication that is conducted by electronic means. In addition, it is essential to also asses the rule applicable to revocation of contract as the technology development has changed the way how and when the acceptance takes place and therefore it can be often discriminatory to bind offeror and leave alternatives largely open for the offeree. Learning From Mistakes The Pact and The Gridiron Gang Essay
It is human nature for everybody to make mistakes. Some mistakes are as little as a typo that can simply be whited out and corrected. Some as big as infidelity in a relationship. Some mistakes are easily forgiven and others not so much. But there is one thing for sure, if mistakes are never made, a person will never know their true purpose in life. Now of course most mistakes you will have to pay for but, every great person has made some sort of mistake to get them where they are now. Every mistake in life is a lesson that contributes to making people successful. The Pact is about three young men (Sampson Davis, George Jenkins and Rameck Hunt) growing up on the streets of Newark, New Jersey around the 1980ââ¬â¢s and follows them up untilâ⬠¦show more contentâ⬠¦After being straight defiant, he picked the slab up and it immediately dropped on his foot, breaking every bone is his foot. Question: Discuss about the International Trade. Answer: Introduction International trade can be termed as the key to the development and prosperity of Australia. This very connection with the world market that gave this country the stale for its mining and farming and agricultural industries. Large scale trade with the foreign markets also acts as the support base for the other industrial sectors as well. These foreign market or the transactions with the foreign markets have now become easy to access as they are very easily reachable through foreign trade and foreign investment as well (Meyer Peng., 2016). Thus, it is under stable that Australia needs to maintain a very healthy and smooth relation with all its foreign clients in order to have a proper International trade market (Weatherall 2015). In this modern era of science and technology, it becomes all the very essential to have a strong technological base as well. Australian business benefits a lot from the technology and scientific equipment transfer that takes place from abroad and this, in turn, is very much beneficial for the domestic economy as well as it benefits from the efficiency and the improvement that is available from the foreign technologies. Another important factor of this business efficiency is the large scale availability of the imported consumer goods which are competitively priced and consequently these imported consumer goods helps in adding some extra value that all the Australians get from their income. But in order to avail such advantages from the international trade. WTO WTO is the only organization that promotes free trade and enables the countries all over the world to undertake foreign trade. This organization looks after the foreign trade transactions and also promotes a smooth and organized business relation within the countries. It also encourages the countries to adopt the necessary measures and undertake the negotiations needed for foreign trade transactions. Australia must be open towards accepting trade relations with the foreign countries by supporting organizations like the WTO or the World Trade Organization which helps in promoting and encouraging open trade overseas ( Taylor Yang2015). The World Trade Organization and the multilateral trading system have generated a considerable amount of revenue both for Australia and for the rest of the world economies as well. Trade is very much essential to the economic prosperity of Australia. The quality of Australian trade representation in Geneva has also helped in giving a great boost to the trade and commerce base. Another important and notable significance of WTO was the inclusion of the agricultural products in the Uruguay round, since one of the major strengths of Australia is its agricultural output. Apart from this, the WTO also helps in the proper negotiations among different countries and their tariffs and this also enable Australia to reduce the Chinese tariff rates on Chinese wine, cheese, and several other items. It is because of the policies f WTO that Australian firms have become much more innovative and productive. Though WTO has really helped Australia to reduce its tariff rates and enrich them in terms of foreign technological know-how that has altogether given a strong boost to their industrial environment, it also brings along with some threats as well, it creates too much pressure on the Government to become even more protectionist. These negotiations often take a very long time to be proposed and accepted and then implemented by the Government, as a result of which the miners and farmers will have to wait for a long duration of time to get any instrumental economic changes. As is already evident that agricultural sector forms a major part in contributing t the Australian economy, and it is also the most distorted sector all around the world, so, the WTO must formulate some new round of negotiations that will make the trade opportunities much more open, transparent in terms of International trade. Paris attacks Any terrorist attacks taking place anywhere in the world affects the day to day lives a great deal. It not only hampers millions of lives of people about disrupts the market and the business and the country which undergoes through such trauma usually is rendered economically and socially weak for a long period of time, there is a large scale loot and plunder done by the enemy armies, the market and the transportation and communication is rendered totally destroyed, hence no business transaction is undertaken for a long time period until normalcy is restored. The terrorist attacks also have a harmful impact on the markets thus causing great pressure on the economic set up of the country The Paris attacks apart from causing a major physical destruction also destroyed the machines, communication, and transportation systems (Estrada Koutronas ., 2016). The productive resources that might have generated valuable goods and services are destroyed, while other resources are diverted and use d for boosting up the military purposes. So, none of this adds anything to the standard of living. International investment and cooperation are absent in a time haunted by terrorism. In this ti, me of severe death and destruction, no markets are ready to undertake any trade transactions and particularly if those trades are to be carried on overseas. Moreover, the transportation and communication system is also largely disturbed and there can be chances of robbery and theft in the route of transportation of goods either in terms of export or imports, as a result of which there are chances of artificial crisis in the market that occurs due to hoarding of goods and this leads to a hike in price of the daily consumer goods, as a result of which there is a pressure created in the markets. Global Financial crisis of 2009 The major impact was the reduction of wealth among the households of Australia as there was a large reduction in the equity prices. Oil prices Whenever there is a sudden increase in the oil prices, the world economy suffers several changes, and the international trade also gets affected a great deal. The countries that export oil may face major los if due to the price rise; the other foreign countries reduce or stop their oil imports. The economies that are not importers of oil can suffer a loss in the purchasing power if there is an increase in the price of oil, this affecting the national income, in the past few years, Australia has tried to keep the imports of oil related products slightly higher than the exports. Fuel consumption is also being reduced due to the high price of these products. As a result of which there has been in the sale of the small cars than the large vehicles and the passengers cars. Free trade agreements Free trade agreements have proved to be very beneficial for the several countries as it is helpful not only in reducing tariffs but also helps to develop better and smooth trade relationships ,promotes cooperation among two countries and also increases the total production as there is better exchange of knowledge , Which consequently increases the GDP. Free trade agreements have proved to be very beneficial for the Australian markets as it is helpful not only in reducing tariffs but also helps to develop better and smooth trade relationships between two countries, encouraging investment and also promotes cooperation among two countries thus making the trade relations work easily. This also helps in increasing the total production of Australia and contributes towards increasing the GDP by giving a boost to domestic business as the inputs are available at a much cheaper rate; it also helps in introducing new technologies and fosters competition and diversity among the countries. It also helps in providing sustainable growth of the less developed economies. China and Indias influence on global economy Chinas influence on the global markets has been two fold and different for different countries, China on hand gives a very strong competition to the other countries, thus making most the economies to undertake trade relations with them, because most of the countries around the world are eager to enter into business relations with china because of its highly advanced workforce and technical knowhow. Chinas transition from an investment oriented economy to a service oriented one is underway, this has led to a sharp increase in the price of Australias imports and a fall in the exports thus creating a pressure on the national income (Liu et al 2016). But it also brings some opportunities s well, there is a well educated and well-trained work force having good knowledge about the production and about the existing business environment. It also gives a free entry to several cultures which helps in imbibing the diversified and wide range of features thus making the economy a multi cultural o ne. It is an open economy (Heilmann et al., 2014). The relationship between India and Australia has developed over the years. Economically speaking, the trade relationship between the two countries has increased rapidly in terms of merchandise trade. India is the largest importer of Australian coal and wool. It is also assumed that in the coming years, Australia will remain quite attractive to India because the Indian population is expected to rise and this, in turn, will create a huge demand for agricultural products and energy sources thus, creating a huge market for Australian exports. Stock market Changes in stock market that is sudden increase or fall in the price of shares in the stock market affects the global trade relations, falling price of shares renders the firms unable to raise finance, and the customers tend to invest more in gold and government bonds rather than in shares, as a result of which the business relations also get hampered. If Movements in the stock market can have a considerable amount of impacts on the economy as well as on the day today lives of people (Rimmer, 2017). If there is a sudden fall in the price of the shares, it can have a widespread damage to the economy. As the Australian share market went on a rollercoaster price hike and then suddenly suffered a loss, it is assumed that the Australian economy can suffer a lot. It I likely to have damaging effects on property, job security, savings of people and it is also a risk for the small business owners. The overseas trade however4 face several risks due to the changes in the stock market like curr ency risk, liquidity risk, and bottom line risks. At the same time, favorable changes like price hike of the shares I the stock market can greatly help the country to diversify its portfolio and earn considerably higher returns. An analysis and assessment of the international business and electronic commerce market Uber Uber has evolved from just an app to the highly valued start-up in the world. Uber is very much focussed on building its business (Sander Pattison 2016). This company has changed its agenda from providing rides on demand to also providing some free service like transportation during blood donation camps, caste votes, donate clothes etc. It is also said that Uber may be able to benefit drivers across 47e cities and 76 countries where it works. This app is quickly expanding in the developing countries of the world and it is definitely helping to give the global trading affair a great boost because transportation and communication is an integral part of global or overseas trade and one definitely needs to have a smart and quick service to deliver the goods and services to and from the desired locations at right time without any delay. It is easily accessible through smart phones and the app is also very easier to handle. Uber rides have become widely popular in Australia and particular ly in Sydney, and is also helping to give the global trade a major boost by helping to make the communication and transportation system easier and faster. However, there is also the threat of pollution as it emits harmful chemicals from the large scale usage of petrol and diesel, so it is recommended that as Uber operates on a very large scale, it must adopt eco friendly car fuels and must get the car's pollution free measures to check the emission of harmful chemicals into the atmosphere. UberEATS The electronic commerce market is taking a major move towards uplifting the International trade so as to increase the total economy of the country. In today's scenario, the consumers are looking forward towards newness and innovations in every goods or service that they use and they are also in demand for faster and easier services. UberEATS brings a variety of food at the desired locations of the buyers, so not only does it help in satisfying the hunger but also it fulfills the desire of having several varieties of food just with the help of a single app. It has also become quite popular in Australia as it is helping in attracting a huge number of buyers, thus increasing the goodwill and strengthening the customer base. As it brings a variety of food from different cuisines, so International trade is also boosted by it because people from all across the globe will use this app to get the food of their choice and the added advantage is the reliability and the speed of Uber cabs as we ll. Netflix This has also helped to give the overseas trade a big boost because it helps in providing media streaming, videos online and DVDs on mail, so it is something that will be opted by people living all around the world. But at the same time, this electronic commerce segment has to work hard in order to gain popularity globally. As has been seen, it does not have sufficient content internationally and owing to this problem of limited content, its service becomes quite expensive in different parts of the world. Bitcoin This is one of the modern scientific technologies that help in passing the trade transaction information from one party to the other through encrypted codes and messages so that they stay secure and cannot be decoded by hackers or other business rivals (Davids 2014). They can be termed as the encrypted currency, but as technology has it, anything that is built and no matter how much strength it is built it can be broken down and there always remains the threat of hackers hacking the important business information so measures are being adopted to make these systems much stronger and secure. Airbnb This particular e-commerce platform is one which is giving the international trade a great boost because it is an app through which, people can get to choose the best places like hotels, motels etc where they can stay at the considerable price in their desired locations. This is thus helping to save the valuable time and energy of delegates who have to travel overseas in order to carry on business transactions, this app helps them to easily locate and book hotels or other staying places in their desired locations. This indeed is a faster, rapid and very useful service in terms of global trades. Airtasker In todays modern scenario, international trade is the key factor we for the development of many countries and this app is very useful in carrying out the international business transactions (Meltzer 2016). Speaking about Australia, this app has been developed in Sydney and is giving a considerable encouragement to the overseas trade of not only Australia but the entire world as well (Erickson Legging ., 2015). It provides the service of online mobile marketplace enabling which is one of the easiest, faster and handy ways to carry on the overseas trade, there is no loss of time and no time is wasted on negotiating about the service prices, the users who need the outsourcing to be done gives the detailed description of the task and then the members bid and negotiate the price among themselves. Drones Drones are now being extensively used in order to make the global business transactions safe and secure and indeed they are a very helpful tool for promoting the overseas business (Vidmer et al 2015). A good application can be seen in case of the ship carrying cargos and happens to pass by a dangerous passageway, in such as a drone can be launched into the sky which will track and alert the captain of the ship about the passageway and about any danger lying ahead, hence this application is immensely useful for carrying the overseas trade in a safe and secure way. One of the major advantages is that it has the ability to view and track things without putting anything or anyone into harm (Barratt, Ferris Winstock., 2014). Driverless cars This is an ongoing experiment in the field of technology and modern science to create this path breaking electronic invention on driverless cars where no drivers will be needed to run or control the cars, they will be based on the robotic technology and will be remote auto controlled. This will make the transportation and communication to a level that no one could think of before, This indeed will be a great boost to the global business transactions as it will help in saving time and will make the entire process of transaction easier and faster. A risk and impact analysis of the potential market There can be the chance of operational risk as well while implementing these tools for increasing the global transactions. One of the major causes behind 6this type of risk can be the lack of proper knowledge, certain loopholes in the internal management or any external aspect like that of a legal risk (Gamble ., 2017). Apart from this, there can also be the financial risk as well, if the organizations run short of the sufficient amount of funds that are needed for carrying on the international trade because using all the modern scientific and advanced technological methods for the smooth functioning of global trade is too much expensive and complicated as well (Ren, 2014). At times the country might be unable to pay off its debts at a time and can get financially weak and hence run the economic risk (Steemers, 2016) so they must make their business decisions very carefully. A country can also suffer political risk, if it is failing to maintain a favorable climate for the outside inv estors or if it fails to pay or is unwilling to pay off all its debts in spite of having sufficient funds, severe legal actions are taken in such cases ( Gleeson Friel .,2013). North Korea itself has a lot of severe tensions going on within it and is a severe victim of social and political unrest and the major problem lies in the fact that it sees itself as an enemy of America and is also ready to go to the extent of war if needed (Duffy 2014). It also has issues with China regarding its missile testing that entered into the economic zone. It is also due to the large amount of nuclear resources and missiles that are present in North Korea, that the other countries are unwilling to enter into any business relations with them and this, in turn, affects the overall global transactions (Hanson 2017). Russia itself is suffering from a major economic setback for the last few years. In the year 2015, the GDP fell by 3.7 percent, apart from this, Russia has also been facing another severe problem of decline in funds and invest, menus, A sharp fall in the energy crisis has further boosted this economic depression of Russia, in such times it is not at all a wise decision for Russia to go into any major global transactions, else it might suffer from financial, economic or political or risks. Conclusion Thus, it is concluded from this study that, modern science and technology has been playing a major role in inventing several technical devices that in the future years will take life to the next level and if things work as planned, it will also help in encouraging overseas transactions a great deal which in turn will help in increasing the total income of the country. But just as a coin has two sides, science and technology also have its darker side as well, there can be instances where people will try to misuse these for their personal benefit; hence necessary preventions are also to be adopted at the same time. Types of Tests Identifying Down Syndrome
Genetic and Biological Nature Down syndrome refers to the genetic condition under which an individual has 47 chromosomes instead of the accepted 46. The major cause of the syndrome is associated with the existence of extra copy of the 21st chromosome. This kind of Down syndrome is referred to Trisomy 21. The presence of extra chromosome leads to pathology of brain activity.Advertising We will write a custom essay sample on Types of Tests Identifying Down Syndrome specifically for you for only $16.05 $11/page Learn More From a biological point of view, Down syndrome is considered the most frequent reason for human birth defects. However, there is no evident connection between parentââ¬â¢s activities before and during pregnancy and form of Down syndrome (U.S. National Library of Medicine n. p.). Any physical activity that a future mother can perform cannot influence the development of the disease. Despite this, the probability of the emergence of Down s yndrome is highly associated with the maternal age, particularly with teenage pregnancy. The occurrence of the deviation is also possible for the pregnant of older age. Consequently, genetic counseling should play a decisive role in defining the causes of Down syndrome. Types of Tests Identifying Down Syndrome There exist a great number of prenatal tests that can help to identify the presence of Down syndrome during pregnancy. They involve triple screen test, MSAFP test, cordocentesis/PUBS, and amniocentesis, first trimester screen, chorionic villus sampling, and the Quad test. By means of triple screen test, it is possible to identify a maternal bond between mother and fetus (American Pregnancy Association, n. p.). The test also looks for such specific substances as Estriol, human chorionic gonadotropin (hCG), and alpha-fetoprotein (AFP). The test is a non-invasive procedure that is carried by means of blood test with low risk for a developing baby. The triple screen test serves to identify Down syndrome in cases the level of AFP is low and the levels of hGG and estriol exceed the norm. The triple screen test is a safe procedure and no health risk is associated with it. Similar effect is produced by the Quad Test. The Maternal Serum Alpha-Fetoprotein Screening (MSAFP) is carried out during the second trimester an it is also known as Alpha-Fetoprotein Test (AFP). The procedure allows to examine the level of AFP during pregnancy. It is performed as a part of triple screen test.Advertising Looking for essay on health medicine? Let's see if we can help you! Get your first paper with 15% OFF Learn More MSAFP identifies alpha-fetoprotein, which is found in amniotic fluid and fetal serum. The test does not pose any threats to health, except for the discomfort that a patient might feel during blood drawing. Cordocentesis, also known as Percutaneous Umbilical Cord Blood Sampling (PUBS), examines fetus blood to identity fetal pathologies. The test is car ried out by means of ultrasound that determines the location of umbilical cordââ¬â¢s insertion into the placenta. The test can detect chromosome pathologies, such as Down syndrome and define any malformations of the fetus. Although, cordocentesis is recognized as a safe procedure, there is a potential risk of miscarriage that might occur one or two times for every hundred procedures. Amniocentesis test is often chosen by parents who have genetic or inherited concerns and is used to predict if there are specific abnormalities. While carrying the procedures, the health professionals resort to ultrasound as a guide to define the safe needle location in the amniotic sac. Just like PUBS, the amniocentesis test is used to discover chromosome abnormalities and genetic disorders, among which Trisomy 21 is the most common genetic pathology. The procedure can pose serious threats to health of a mother and a fetus. The women can also take a test that combines both an ultrasound evaluation a nd a maternal blood test to detect risk for various chromosomal abnormalities, including Trisomy 21 and Trisomy 18. There are no serious risks and side effects linked to the First Trimester screen, except for the discomfort caused by drawing blood. Parents should be ready for the probability for receiving abnormal results, but further testing can still define that the future baby does not have any pathology.Advertising We will write a custom essay sample on Types of Tests Identifying Down Syndrome specifically for you for only $16.05 $11/page Learn More Chorionic Villus Sampling (CVS) implies removal of chorionic villi cells of the placenta at the point of its attachment to the uterine wall. The procedure opens access to DNA of a potential father to compare it with the DNA of a future baby. The test also defines Down Syndrom by detecting chromosome abnormalities. No associated risk relate to this procedure. In conclusion, because Down Syndrom has a gene tic and biologic nature, the above-described tests can be efficient in detecting the genetic abnormalities. In particular, the test can also define different reasons and nature of the genetic pathology. Works Cited American Pregnancy Association. Prenatal Testing. 2012. Web.
